Agreement to Terms

By accessing our website or engaging our engineering services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Services Description

StructureSmart Engineering provides professional drainage engineering design services, including but not limited to:

• Residential drainage design and permit drawings
• Commercial stormwater management plans
• Septic system design
• Pool and patio drainage solutions
• Permit application assistance
• Engineering consultations

All engineering plans are prepared and sealed by a licensed Professional Engineer (PE) in the State of Florida.

Client Responsibilities

When engaging our services, you agree to:

• Provide accurate and complete property information
• Supply required documents (surveys, existing plans, etc.) in a timely manner
• Respond to requests for information promptly
• Review and approve plans before permit submission
• Pay all fees according to the agreed terms

Project Deliverables

Our deliverables typically include professionally sealed engineering drawings and calculations as specified in your project agreement. The scope of work will be clearly defined in your proposal or contract.

Payment Terms

Payment terms are as follows unless otherwise specified in your project agreement:

• A deposit may be required before work begins
• Balance is due upon delivery of completed plans
• Permit fees paid to government agencies are separate from our engineering fees
• Rush services may incur additional fees

Revisions Policy

Our standard service includes:

• Reasonable revisions to address permit reviewer comments (at no additional cost)
• Minor adjustments during the design process

Additional charges may apply for:

• Major scope changes after design approval
• Changes due to inaccurate information provided by client
• Revisions requested after final plan delivery

Intellectual Property

Engineering plans and designs created by StructureSmart Engineering remain our intellectual property until full payment is received. Upon payment, you receive a license to use the plans for the specific project and property described.

Limitation of Liability

Our liability is limited to the fees paid for the specific services rendered. We are not liable for:

• Delays caused by permitting authorities
• Issues arising from construction that does not follow our plans
• Problems caused by undisclosed site conditions
• Consequential or incidental damages

Disclaimer

While we maintain high standards and a 100% first-time permit approval rate, we cannot guarantee permit approval, as final decisions rest with the permitting authority. We will work diligently to address any comments or revisions required by reviewers.

Cancellation Policy

If you need to cancel a project:

• Before work begins: Full refund of any deposit
• After work begins: Payment for work completed to date
• After plan delivery: No refund applicable

Governing Law

These Terms of Service are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Palm Beach County, Florida.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute through good-faith negotiation for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, either party may pursue mediation before a mutually agreed-upon mediator in Palm Beach County, Florida. If mediation is unsuccessful, either party may pursue resolution through the courts of Palm Beach County, Florida, as specified in the Governing Law section above.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modified terms.
